배고파 개 사료 먹은 2살 결국…친모·계부 학대살해 인정

 

두살 난 딸을 굶겨 아이가 개 사료를 먹게 하고 끝내 숨지게 한 친모와 계부가 아동학대 살해 혐의를 모두 인정했다.

 

울산지법 제11형사부(재판장 박현배 부장판사)는 20일 아동학대범죄의 처벌 등에 관한 특례법 위반(아동학대살해) 혐의로 기소된 친모 A(21)씨와 계부 B(28)씨에 대한 첫 재판을 진행했다.

 

이들은 2021년 10월부터 2022년 3월까지 울산 남구의 원룸에 2세 딸과 생후 17개월 된 아들에게 식사를 제대로 제공하지 않고 방치했다. 결국 딸은 영양실조와 뇌출혈 등으로 숨졌다.

 

이날 재판에서 A씨는 “공소사실을 모두 인정한다. 아이들의 부모로서 신경을 쓰지 못해 정말 죄송하다”고 말했다. B씨도 혐의를 모두 인정했다.

 

다음 재판은 5월 27일 오전 11시 울산지법 301호 법정에서 열린다.

 

검찰 수사 결과, 계부 B씨는 2세 딸이 숨지기 전 배고픔에 개 사료를 먹고 바닥에 쓰려져 있는 것을 보고도 별다른 조치를 하지 않고 오히려 이를 사진으로 찍어 A씨에게 전송한 것으로 드러났다.

 

검찰은 “피고인들은 피해자가 사망할 수 있다는 점을 인식하고도 음식물을 제공하지 않고, 계속 방임했다는 점에서 살인의 미필적 고의가 인정된다”고 밝혔다.

 

사망한 31개월 여아의 몸에는 별다른 외상은 없었다. 그러나 몸무게는 7㎏에 그쳐 또래 아이들 평균 몸무게의 절반에 불과했던 것으로 알려졌다.

 

또한 17개월 된 남아도 정상 몸무게에 훨씬 미치지 못한 영양실조 상태로 발견됐다. 이들은 아들을 상대로도 상습적 방임과 함께 신체적 학대까지 한 것으로 조사됐다.

 

검찰 관계자에 따르면 친모 A씨와 계부 B씨는 사실혼 관계로 파악됐다. A씨는 수년전부터 별거한 남편과의 사이에서 여아를, 현재 동거남과의 사이에서 남아를 각각 출산한 것으로 알려졌다.

 

검찰은 17개월 남아에 대해 울산 남구청, 아동보호전문기관, 범죄피해자지원센터 등과 지속적인 양육 및 보호 방안을 논의 중이라고 밝혔다.

The 11th Criminal Division of the Ulsan District Court (judge Park Hyun-bae) held its first trial on the 20th against the mother A (21) and stepfather B (28) who were charged with violating the Special Act on the Punishment of Child Abuse Crimes.

 

From October 2021 to March 2022, they left their 2-year-old daughter and 17-month-old son in a studio in Nam-gu, Ulsan, without properly providing meals. Eventually, her daughter died of malnutrition and cerebral hemorrhage.

 

At the trial, A said, "I admit all the facts charged. I'm really sorry that I couldn't care less as a parent of my children. B also admitted all charges.

 

The next trial will be held at 11 a.m. on May 27 at the Ulsan District Court No. 301.

 

According to the prosecution's investigation, stepfather B saw his second-year-old daughter eating dog food and being bitter on the floor before she died, but did not take any action, rather taking a picture of it and sending it to A.

 

The prosecution said, "The defendants did not provide food even though they recognized that the victim could die, and the intention of murder was recognized in that they continued to neglect."

 

There was no major trauma to the body of the 31-month-old girl who died. However, it is known that the weight was only 7kg, which was only half of the average weight of children of their age.

 

In addition, a 17-month-old boy was found to be malnourished well below his normal weight. They were found to have habitually neglected their sons and even physically abused them.

 

According to a prosecution official, the real mother A and her stepfather B were found to be in a de facto marriage. It is known that A gave birth to a girl between her husband who has been separated since many years ago and a boy between her current cohabitation.

 

The prosecution said it is discussing ways to continue raising and protecting 17-month-old boys with Ulsan Nam-gu Office, child protection agencies, and crime victim support centers.
